the complaint sought a of (1) to saline county clerk, requiring him to his duties, and (2) to school district to the rollback form and roll back its tax rate pursuant to state constitution. the taxpayers further sought a of to the collection of real property taxes in of 59. finally, they sought to the appellees from further violations of 59. the school district moved to the taxpayers' complaint for lack of matter jurisdiction. the saline county clerk and collector moved similarly and asserted that taxpayers' claims were required to in court because they involved county taxes.
the taxpayers replied that taxes at issue were school district taxes as to taxes, and, thus, circuit court was the appropriate jurisdiction. they further referred to prayers for and prohibition, remedies which typically lie in court. the taxpayers subsequently supplemented their response to motions to . they contended that assuming that school district tax was a tax, jurisdiction in court was still proper because the case involved an exaction. the school district replied that case did not involve an exaction but a tax that was illegally collected. after a on motions to , the trial court found that school district tax was indeed a tax, and that under foster v. jefferson county quorum court, supra, jurisdiction was vested exclusively in court. the trial court also concluded that matter more appropriately lay in chancery court as to court because injunctive relief was sought.
